Gender Discrimination

State and Federal law requires that each sex receive equal pay for equal work.

Laws protecting each gender also extend to all aspects of employment, including hiring, promotion, pay and firing. The law does give employers the ability to pay a worker more for equal work if that employee has earned seniority.

Companies do have the ability to specify different dress codes for each of the sexes, depending on the type of work the job requires. For example, an employer may require men to wear a tie, while the same requirement does not apply to women. The requirement to wear a tie is not discriminatory.

Many states are passing gender discrimination laws that effect homosexual individuals. Since those laws are quickly evolving, you should check with your local government for guidance.
